RULES OF THE "Kanaba CUP" COMPETITION

§1

  1. These regulations (hereinafter: “Regulations”) define the rules, conditions of participation, the rights and obligations of participants, applicants, as well as the prizes provided as part of the Competition (hereinafter: “Competition”), organized during the Fair Kanaba Fest on May 6-7, 2023 in Katowice (hereinafter: “Fair”).
  2. The Organizer of the Competition is Kanaba Fest Magdalena Buczak ul. Ożarowska, No. 77, apartment 17, 01-444, Warsaw, NIP: 5222828788, REGON: 368423362 (hereinafter: “Organiser”).
  3. The Organizer declares that the Competition is not a game of chance, a raffle, mutual bet, promotional lottery, the result of which depends on chance, or any other form of game of chance provided for in the Act of 19 November 2009 on gambling (Journal of Laws 2009.201.1540, as amended).
  4. The competition lasts from February 20, 2023 to May 7, 2023, 3:00 p.m. and is organized on the territory of the Republic of Poland.

§2

Contest categories

The categories in which prizes are awarded as part of the Competition are as follows:

The Best Stand of the Fair;

Cannabis Personality of the Year 2022;

Best Product 2023;

The best CBD and CBG drought;

§3

Participation application Best Product 2023, Best Drought and Industry Personality

  1. Applications in the categories of Best Dried, Best Product 2023 and Personality of the Cannabis Industry of 2022 are made from February 20, 2023 to April 20, 2023 via the application form available at www.kanabacup.pl and www.kanabacup.com in the tab under the name “Kanaba Cup”. The application may be made by a natural person or a legal person.
  2. In the case of the Best Product 2023 and Best Dried CBD and CBG categories, after completing the form, the applicant receives a VAT invoice covering an initial fee of PLN 500.00 gross for the application for participation in the competition.
  3. In order to successfully submit an application in the Best Dried or Best Product 2023 Category, an initial fee of PLN 500.00 gross must be paid to the organizer’s bank account and the transfer title should include the number of the VAT invoice received by the applicant from the Organizer in accordance with section 2 above.
  4. The applicant may submit an application in the Best Product 2023 Category and the best CBD and CBG dried material, with the proviso that the products submitted must meet the requirements for a given Category. If you submit an application in two categories, you must pay a fee for each category.
  5. If it is impossible to register via the Form referred to in paragraph 1 above, please contact the Organizer directly at the e-mail address info@kanabafest.com.
  6. If it is necessary to pay the entry fee, the application is accepted if the Organizer records the payment for participation in the Competition.
  7. After making the payment, the applicant should contact the Organizer at the e-mail address info@kanabafest.com and present the confirmation of the transfer in order to be properly booked.

§4

The rules of the competition for the best drought

  1. As part of the Competition, only CBD or CBG drought is evaluated. In order for the dried material to qualify for the next stage, it must meet the following requirements:
  2. After qualifying for the Competition, the applicant receives a bar code generated by the Organizer to the e-mail address indicated by him. This code should be stuck on the container in which the drought will be sent for the Competition examination. The Participant should send a minimum of 13 grams of dried material to the Competition. Too little can prevent proper use testing the sample, which may result in incorrect or unreliable test results, which the applicant accepts by accepting these Regulations and does not raise any objections.
    • the THC content must not exceed 0.34;
    • the CBD content should exceed 1%;
    • may not contain HHC in its composition;
    • it cannot be counterfeited, crushed. An undamaged part of the dried material or the whole flower should be delivered to the Competition;
    • must not be visibly moldy or infested with insects;
    • must not contain pesticides, mold or heavy metals;
    • must not be too moist in organoleptic evaluation.
  3. The participant is obliged to provide reliable information in the form referred to in § 3 section 1. Lack of any required information or providing false information will result in disqualification without the obligation to return the entry fee.
  4. Drought is tested by a specialized laboratory, which evaluates it in terms of acceptable parameters. If a sample is found to exceed the permissible THC concentration, i.e. >0.34% THC or pesticides, mold, growth regulators or residual salt content above 500 ppm, this sample will not take part in the Contest and will be legally disposed of. In this case, the entry fee is not returned to the Participant.
  5. In the dried samples that will be admitted to the Competition, the level of CBD, THC, CBG cannabinoids and CBD-A and CBG-A cannabinoid acids will be measured according to the following rules:
    • for every 1% of cannabinoid content, the herb receives 1 point in the classification;
    • for every 1% of cannabinoid acid, the herb receives 1 point in the classification;
    • the amount of THC may not exceed the permissible concentration in Poland, i.e. 0.34%;
    • in the case of exceeding the amount of CBD in a given sample of dried material above 10%, each percentage above this amount receives 1.5 points.
  6. The percentage of CBD and CBG in the dried material should be at least 1% for the sample to qualify for the second stage. The applicant will be informed about further qualification to the second stage of the Competition.
  7. The samples qualified for the Competition will be handed over to the judges for the second stage.
  8. The evaluations are carried out by judges selected by the Organizer, whose knowledge, experience and skills allow for a reliable assessment of the submitted product. All judges evaluate aroma, taste, visual appeal, presence of seeds in the sample, type of smoke and/or vapor. One of the judges assesses in an additional subcategory called symptomatic effectiveness and determines the level of pain relief, help in falling asleep, etc. The judges evaluate droughts in the following categories and award the following points:
    • aroma on a scale of 1 – 6 (1 – no smell, 6 – intense smell, consistent with the declared terpenes);
    • taste 1 – 6 (1 – no or unpleasant taste, 6 – taste with noticeable terpenes, consistent with the declared terpenes);
    • visual attractiveness 1 – 6 (1 – lack of resin, excessive amount of chlorophyll, too much moisture, ugly structure, immature, 6 – large amount of resin, low amount of chlorophyll, mature, beautiful structure, optimal humidity);
    • smoke smoothness 1 – 6 (1-biting, causing excessive coughing, 6 – non-biting, not causing excessive coughing);
    • steam smoothness 1 – 6 (1 – biting, causing excessive coughing, 6 – non-biting, not causing excessive coughing);
    • ash purity 1 – 6 (1-very dark, 6 – very light);
    • seed content 1 – 6 (1 – a lot, 6 – none);
    • medical value 1 – 6 (1- the smallest value, 6- the highest value) is assessed only by the judge assessing in the category of symptomatic effectiveness)
  9. The points from the first stage (laboratory test) are added up with the points received from the judges and droughts with the highest number of points are awarded the first place. Two awards will be given to products with the second and third highest number of points, respectively. In the case of the same number of points, ex aequo places are awarded.
  10. The prizes for the best drought are: for the first place there is a statuette and a material prize, for distinctions there is a statuette. The value of the prizes, both for the first place and for distinctions, shall not exceed PLN 2,000.00 (say: two thousand zlotys 00/100)
  11. Winnings cannot be cashed or transferred to third parties.

§5

Best Product Contest Rules

  1. After submitting the application in accordance with the wording of paragraph 3, the submitting entity waits for the contact of the Organizer in order to receive the shipping address.
  2. A product can be submitted by the product owner, its originator or distributor. By accepting these Regulations, the Submitting Party declares that it has copyrights or other legal title to use the given product, in particular to submit it to the Competition, and has not infringed proprietary copyrights, patents and other rights.
  3. In the case of submitting the same product by two or more entities, priority and entitlement to participate in the Competition is vested in the first place in the owner, then the originator, and in the case of submitting the same product by two distributors, the entity that first submitted the application (the date of receipt of the form by the Organizer is decisive).
  4. Products that may qualify for the Competition are:
    • containing cannabinoids or cannabinoid acids;
    • made of hemp fibre, plastic or other derivative of hemp, excluding dried material;
    • all products for the consumption of cannabis, i.e. water pipes, vaporizers, grinders, tablets, etc.
    • cannabis growing products: fertilizer, lamp, fan, etc.
  5. Due to the nature of the Competition, products that cannot be sent by courier in accordance with the relevant regulations of carriers cannot participate in the category for the best product. The total weight of the products cannot exceed 31.5 kg.
  6. Alcohol, weapons, pornographic products, products contrary to the law, ethical principles or other reasons that make them unsuitable for public presentation are excluded from the Competition.
  7. After the end of the Competition, the products are not returned to the applicant. The value of the product submitted to the Competition may not exceed PLN 2,000.00 (say: two thousand zlotys 00/100).
  8. After receiving information from the Organizer about the shipping address, the applicant sends 3 copies of the product to this address to be handed over to the judges.
  9. Each of the judges assesses the product from 1 to 10, taking into account the following criteria: general impression of using the product, whether the product meets its intended purpose, mechanics and principles of operation of the product, ease of use, whether there is a manual for using the product and whether it complies with the manual, features characteristic (shape, ergonomics, how it differs from the competition), material, intuitiveness, compliance with the description, uniqueness of the product, price-quality ratio, would you spend money on it.
  10. The winners of the Competition will be announced during the Fair on May 7, 2023 at 16:30.
  11. The product with the highest number of points receives the first place, the products with the second and third highest number of points, respectively, will receive distinctions. In the case of the same number of points, ex aequo places are awarded.
  12. The prizes for the best Product of 2023 are: a statuette and a material prize for the first place, a statuette for distinctions. The value of the prizes, both for the first place and for distinctions, shall not exceed PLN 2,000.00 (in words: two thousand zlotys 00/100).
  13. Winnings cannot be cashed or transferred to third parties.

§6

The personality of the industry

  1. Personality of the hemp industry is a category aimed at distinguishing a person who has particularly distinguished himself for the hemp industry. When submitting a person to the Competition, the personality of the industry should take into account the following circumstances:
    • achievements in the hemp industry, such as: the results of professional work, scientific research, business, managerial and popularizing activities, social activities;
    • the impact of a given person’s activity on the development of a specific company or sector, industry, organization, research teams or impact on decision-making processes, research topics, legislative processes, opinion-forming processes relevant to the hemp sector;
    • achieved results of other activities having a significant impact on the industry and its popularization innovation and creativity, as well as development and membership in national and international associations;
    • The Personality of the Year does not have to be characterized by a specific activity for the hemp market, hemp, or promoting hemp in a given year. It can be a reward for the entirety of such a person’s activities.
  2. Applications via the form referred to in paragraph 3 section 1 may be made on one’s own behalf or by a third party. If you submit your application on your own behalf, you must accept the wording of these Regulations. Only natural persons who are 18 years of age and residing in the territory of the Republic of Poland may participate in the Competition.
  3. In the case of a candidacy submitted by a third party, it is necessary to provide contact details enabling the Organizer to contact this person. In the event of providing incorrect, incomplete or missing contact details, the Organizer cannot contact the registered person, which means that the registered person will not take part in the Competition.
  4. After receiving a candidacy from a third party, the Organizer informs the person whose candidacy was submitted about the receipt of his candidacy. This person, within 7 days of receiving information about submitting his candidature, agrees to participate in the Competition by sending the organizer by e-mail (kanabacup@kanabafest.pl) a signed consent to participate in the Competition and acceptance of the Regulations. If the Organizer does not receive consent and acceptance of the Regulations, the submitted person shall not take part in the Competition. If consent is not obtained, the Organizer does not make repeated attempts to obtain consent by the same contact method. The Organizer does not make repeated attempts to obtain consent in the event of receiving an objection to the processing of personal data from the reported person.
  5. The Organizer also accepts the suggestions of the Internet community before the start of Kanaba Fest after obtaining the appropriate consent of the person and acceptance of the Regulations.
  6. The organizer places the accepted personalities in an online survey. With the beginning of the Fair, voting begins. Voting takes place by the participants of the Fair in accordance with the “Rules of voting during the Kanaba Fest Fair”.
  7. There is no limit to the number of people participating in the Competition.
  8. The announcement of the winners takes place during the Fair, on 7.05, at 16:30.
  9. The person who receives the largest number of votes in the Participants’ voting referred to in section 6 above receives a statuette and a material prize. The total value of prizes for the Winner will not exceed PLN 2,000.00 (say: two thousand zlotys 00/100).
  10. Winnings cannot be cashed or transferred to third parties.

§7

Best Stand

  1. Exhibitors who, during the application for participation in the Fair, agreed to participate in the Competition and accepted these Regulations are the exhibitors participating in the Competition. Lack of one of these declarations prevents the Exhibitor from taking part in the Competition.
  2. The exhibitor who receives the largest number of votes in the voting of participants during the Fair receives a prize in the form of a free 4×4 stand at the next Kanaba Fest and a statuette. The value of the free stand is PLN 1,600.00 (say: one thousand six hundred zlotys 00/100), and the value of the statuette is PLN 100.00 (say: one hundred zlotys). The total value of prizes for the Exhibitor who wins the competition is PLN 1,700.00.
  3. The exhibitor may not convert the winnings into cash or transfer them to third parties.

§8

Rights and obligations of Participants, Exhibitors and the Organizer

  1. The Participant, the Applicant and the Exhibitor are obliged to:
    • comply with the Regulations;
    • providing any information related to participation in the Competition to persons and entities carrying out control, monitoring and evaluation of the Competition;
  2. The Organizer is not responsible for the reliability and truthfulness of the data of the Competition Participants, including the impossibility of transferring them prizes, for reasons attributable to the Participant or the Exhibitor, in particular if:
    • The Participant has not provided true and correct contact details;
    • The Participant did not show up to receive the Prizes;
    • The Exhibitor may not participate in the subsequent Kanaba Fest Fair covered by the award;
  3. The Organizer is not responsible for any disruptions in the operation of ICT connections, servers, interfaces, browsers.
  4. The Organizer reserves the right to refuse to qualify, disqualify, exclude from the Competition any entity or persons participating in the Competition in order to protect competition and ensure the security of the Competition.
  5. The Participant is obliged to promote the Kanaba Cup Competition in their social media and other channels to reach recipients.
  6. In the event of a violation by the person participating in the Competition of the provisions of the Regulations, the Organizer is entitled to exclude them from participation in the Competition without the right to return the entry fee, if it has been paid.

§9

Complaints

  1. Any complaints regarding the manner of conducting the Competition should be reported to the Organizer not later than within 7 days from the date of its completion.
  2. A written complaint should contain the name, surname and exact address of the Participant, as well as a detailed description and reason for the complaint.
  3. Complaints will be considered immediately, but not later than within 14 days from the date of their receipt by the Organizer.
  4. The Participant is notified of the Organiser’s decision by registered letter sent to the address provided in the complaint.

§10

Processing of personal data

  1. The administrator of personal data processed for the needs of the Competition is the Organizer.
  2. Personal data will be processed in order to:
    • conducting the Competition, issuing prizes, conducting complaint proceedings and protecting claims, which are the legitimate interests of the Organizer (Article 6(1)(f) of the GDPR);
    • making tax settlements, which is the Organizer’s legal obligation (Article 6(1)(c) of the GDPR) resulting from accounting and tax regulations;
    • marketing and promotion of the Organizer’s services, which is the legitimate interest of the Organizer (Article 6(1)(f) of the GDPR).
  3. Personal data may be made available to entities cooperating with the Organizer, if it is necessary due to the specificity of the prize in the Competition, entities authorized to receive personal data under applicable law, as well as entities with which the Organizer has concluded an entrustment agreement, e.g. ICT service providers.
  4. Providing data is voluntary, but necessary to participate in the Competition
  5. The Organizer obtains personal data directly from Participants and Exhibitors. Exhibitor’s personal data and industry personalities may also be obtained on the basis of opinions provided by Participants.
  6. Personal data will be processed until the consent to receive marketing information is withdrawn, or for the duration of the Competition, and then until any claims expire and legal obligations are fulfilled.
  7. Data subjects have the right to access their personal data, rectify it, delete it, limit processing, the right to object, transfer data and the right to lodge a complaint with the supervisory authority.
  8. Data subjects have the right to withdraw consent to receive marketing information at any time without affecting the lawfulness of processing based on consent before its withdrawal.
  9. In matters relating to data processing, it is possible to contact us via the e-mail address info@kanabafest.com.

§11

Final Provisions

  1. These Regulations are public and available on the website where the Contest form is located.
  2. The Organizer reserves the right to change the Regulations only for important reasons such as changing the date of the event, changing the law or other unforeseen circumstances. Changes to the Regulations will in no case infringe the already acquired rights of the Competition Participants. The Organizer will inform the Participants about each change to the Regulations on the Organizer’s website, at least 3 days before their introduction.
  3. In matters not covered by these Regulations, the provisions of generally applicable law shall apply.
  4. Any disputes and property claims that may arise between the Organizer and the Contest Participant in connection with the Contest will first be settled amicably and using all available mediation rules and techniques. In the event that attempts to settle the dispute amicably fail, the parties have the right to pursue their claims in court.
